Competition Terms and Conditions1. General 1.1. The Promoter is Rebel Sport Limited A.C.N. 78 003 283 823 of Level 5, 1B Homebush Bay Drive, Rhodes, 2138 of (the “Headquarters”). 1.2. Entry into the competition is deemed acceptance of these terms and conditions. 1.3. This is a game of skill. Chance plays no part in determining the winners. The winners will be selected by the Promoter’s panel of judges based on the appeal and creativity of the entry submitted. The judges’ decision is final and no discussions or correspondence will be entered into. 1.4. The competition commences on 12:01am (AEST) 23/03/2021 and closes on 11.59am AEST 11/04/2021 (“Promotional Period”). All entries must be received by the Promoter within the Promotional Period. 2. Entry Requirements 2.1. Entry is open to Australian residents aged 18 years and over (“Entrants”). 2.2. To enter the Competition, Entrants must: 2.2.1. create an image or video depicting: 2.2.1.1. the Entrant; or 2.2.1.2. a child of the Entrant (either adopted or biological); or 2.2.1.3. a child who has the Entrant as their appointed legal guardian, only and showing how they are playing more sport in the Easter school holidays; 2.2.2. Upload the photo or video to their Instagram or facebook page and tag @rebelsport and #playmoresports; 2.2.3. agree to these terms and conditions, (“Qualifying Entry”) 2.3. Each child referred to in clause 2.2.1.2 and 2.2.1.3 shall be deemed to have agreed to these terms and conditions and acknowledge the Promoter will have no liability for any loss or damage incurred by such child or the Entrant. 2.4. Entrants may submit multiple Qualifying Entries during the Promotion Period. 2.5. Qualifying Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Each Qualifying Entry will be considered final by the Promoter. 2.6. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupt or misdirected Qualifying Entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise. The Promoter has no control over communications networks or services, the internet or computer or telephone networks and accepts no responsibility for any problems associated with them. Any form of automated entry using any device or software is invalid. 3. The Prize 3.1. The prizes are three (3) x $250.00 rebel e-gift cards (“Prize Pool”) . 3.2. The approximate total prize pool value is $750.00 AUD (excluding GST). The prize is not exchangeable and cannot be taken as cash. 3.3. e-Gift Cards are subject to the terms and conditions imposed by the Promoter (https://www.rebelsport.com.au/customer-service/giftcard-terms.html). 3.4. All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner. 3.5. The Promoter makes no representation as to the safety, conditions or other issues that may exist in relation to any part of the prize. 4. Prize Draw and Notification 4.1. There will be 1 draw conducted to select the 3 winners on Monday 12th April 2021. 4.2. The Promoter will notify the winners in writing by private message on either their Instagram page or facebook page, pending which platform the entry was submitted. 4.3. If a winner fails to claim and collect the prize within seven (7) days of being notified or the winner’s entry is deemed invalid by the Promoter, the winner is deemed to have forfeited and abandoned the prize. The Promoter will select an alternate winner, seven (7) days after notice was given to the original winner, at the Promoter’s Headquarters. The Promoter will promptly notify the alternate winner by email and by phone. If the alternate winner fails to claim and collect the prize within seven (7) days after the Promoter has contacted the alternate winner or the winner’s entry is deemed invalid by the Promoter, the winner is deemed to have forfeited and abandoned the prize. The Promoter is not required to select another winner. 4.4. If any prize is unavailable or otherwise unable to be supplied, the Promoter may substitute the prize with a prize of equal value, subject to any directions from a regulatory authority. 5. General Conditions 5.1. The Promoter reserves the right to verify the validity of entries and the identity Entrants/winner(s), and to disqualify any Entrant/winner which in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualifying any entrant who tampers with the entry process, who submits an entry that is contrary to these Terms and Conditions or who has, in the opinion of the Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or the Promoter. Failure by the Promoter to enforce any of its rights at any stage is not a waiver of those rights. 5.2. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees or warranties. Except for any liability that cannot be excluded by law, the Promoter and its related bodies corporate (including its officers, employees and agents) excludes all liability for any personal injury, death, loss and damage; whether direct, indirect, special or consequential, arising in any way out of the Competition and/or the prize(s), including but not limited to any liability arising from any technical difficulties or equipment malfunction; any reason beyond the Promoter’s reasonable control; any variation of the prize value; any tax liability incurred by the winner or Entrant; or redemption or use of a prize. 5.3. If the Competition is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter is entitled to, the fullest extent permitted by law: disqualify any Entrant; or subject to any direction from a regulatory authority, to modify, suspend, terminate or cancel the Competition. 5.4. The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties or to its related companies and if required, to the Australian regulatory authorities. Entry is conditional on providing this information. 5.5. By submitting an entry: 5.5.1. Entrants warrant and agree that: 5.5.1.1. all entries become the property of the Promoter; 5.5.1.2. all the drawings, photographs, videos and/or recordings, descriptions, texts, comments submitted by the Entrant as their entry for the Competition (“IP”) are their own original work and the entry does not infringe the intellectual property rights or moral rights of any third party; 5.5.1.3. the Entrant will forgo any rights it has in relation to the IP, and assigns all rights, titles, interest, intellectual property rights in the entries and/or IP to the Promoter; 5.5.1.4. the entry does not infringe the privacy rights of any third party and the Entrant has the express consent of all persons appearing in the entry; 5.5.1.5. the Promoter may use, reproduce and publish the IP for any purpose, in perpetuity and throughout the world and the Entrant will not be entitled to any fee or payment for such use; 5.5.1.6. the Entrant indemnifies and keeps the Promoter indemnified against all liability the Promoter incurs of and incidental to any claim by any third parties against the Promoter for the infringement of the third parties’ intellectual property rights or privacy rights; and 5.5.1.7. the IP has not been digitally altered or manipulated in anyway. 5.5.2. Entrants expressly consent to the Promoter using: 5.5.2.1. the Entrant’s entry (either in part or in full), name, likeness, image and/or voice to be reproduced and/or published in any medium for an unlimited period without remuneration for the purpose of promoting this Competition, the Promoter’s business, and any products manufactured, distributed and/or supplied by the Promoter; and 5.5.2.2. Entrant’s personal information and entry for promotional, marketing, publicity, research, and profiling purposes, including sending electronic messages or telephoning the Entrant. Personal information will only be used in accordance with the Promoter’s privacy policy (https://www.rebelsport.com.au/customer-service/privacy-policy.html) and the Entrant hereby agrees to and accepts that policy. 5.6. The Entrant being the parent or guardian of a child referred to in clause 2.2.3 must: 5.6.1. acknowledge that they are the parent or guardian of the said child; 5.6.2. confirm that they are over the age of 18 years old; 5.6.3. agree to these terms and conditions in their own capacity and on behalf of the said child; 5.6.4. confirm the said child has complied with, and will continue to comply with the terms and conditions to the extent applicable; and 5.6.5. indemnify the Promoter from and against any and all losses, costs, damages, expenses, liabilities and claims arising out of and to the extent that any of the terms and conditions of the Competition are unenforceable against the child or invalid because the child is a minor. 5.7. If any prize (or any portion of a prize) becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize (or portion of a prize) of equal or greater value, subject to any written directions from the various authorities. Winners will not be entitled to any additional compensation in the event that the prize or portion of the prize has been substituted at equal or greater value. 5.8. In the event of war, terrorism, pandemic, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Competition or suspend or modify a prize, subject to any written directions from a relevant regulatory authority. 5.9. The Promoter will endeavour to provide the Entrant with an option to opt out of receipt of such communications every time the Promoter contacts the Entrant. Entrants should direct any request to access, update or correct information to the Promoter. 5.10. Where the Competition is communicated on Facebook or Instagram, Entrants and participants in the Competition acknowledge that the Competition is in no way sponsored, endorsed or administered by or associated with Facebook and Entrants and participants in the competition release Facebook or Instagram and its associated companies from all liability arising from the competition. Entrants provide their information to the Promotor and not Facebook or Instagram.
