rebel active Terms and Conditions

YOU MUST READ THESE TERMS AND THE REBEL PRIVACY POLICY, AS THEY CONTAIN IMPORTANT INFORMATION ABOUT THE REBEL ACTIVE PROGRAM. BY SIGNING UP TO THE PROGRAM, YOU AGREE TO THESE TERMS INCLUDING THE PRIVACY POLICY (“TERMS”), AS AMENDED FROM TIME TO TIME.

1. Your participation and Membership

1.1. Participation in the Program is open to individuals with a unique email address and an Australian residential address. Participation in the Program by corporations, businesses and employees of Rebel is prohibited.

1.2. By participating in the Program, You:

1.2.1. agree to these Terms and the collection, use and disclosure of your personal information in accordance with the Privacy Policy, as amended from time to time;

1.2.2. consent and agree to receiving marketing information, Benefits, and general information (“Rebel Sport Information”) from Rebel in writing, via email, SMS, Push Notification (where applicable), by telephone or any other means.

1.3. You must advise Rebel of any change of name, address, email or other details as soon as practicable after the change. Rebel is not responsible for any loss of any benefits made available to You in connection with any failure by You to notify Rebel of any change in your details. Rebel may require acceptable proof in relation to any change of details. Changes can be made directly by accessing Your online account on www.rebelsport.com.au/account/login or by contacting the Rebel Customer Service Team.

1.4. Rebel may issue You a Rebel Active Card promptly on participation in the Program. You must advise Rebel as soon as practicable if a Rebel Active Card is lost or stolen. You may request a replacement or temporary card directly in any Rebel store.

1.5. You may use the Rebel Active Card at any Rebel store or on the Website. If You do not have your Rebel Active Card with you in any Rebel Store and You wish to redeem any offer, You may identify yourself to at the time of purchase. By providing details in order to be identified, each Rebel Active Member agrees to be bound by these Terms.

1.6. Rebel may in its discretion, refuse participation in the Program for any reason.

2. Termination

2.1. Rebel may in its discretion, suspend, change or terminate Your participation in the Program, if Rebel reasonably believes that You have:

2.1.1. breached these Terms;

2.1.2. engaged in fraudulent conduct or conduct that is suspected to be fraudulent in relation to your Program account;

2.1.3. engaged or may engage in inappropriate conduct that undermines the legitimate interests of Rebel (for example, theft from a Rebel Store, or providing misleading information).

2.2. Where Rebel intends to terminate your Program account, Rebel will provide You with written notice of such termination and you will have 14 days to rectify the breach (where possible) and/or advise Rebel in writing as to why your Program account should not be terminated. Rebel will review any response you provide and will advise You of its decision.

2.3. You may terminate your participation in the Program at any time by:

2.3.1. providing written notice to Rebel by visiting www.rebelsport.com.au/contactus; or

2.3.2. calling the Rebel Customer Services Team.

2.4. Within a reasonable time of receiving notification of termination from You, your Program account will be recorded on the Rebel Active database as cancelled.

2.5. Rebel may terminate the Program at any time by providing at least 14 days prior notice on the Rebel Active website.

3. Communications

3.1. If You select the “opt-out”/ “unsubscribe” link at the base of any Program email, you will no longer receive direct email marketing communications from Rebel. You may still receive direct SMS marketing communications unless you also select the “opt-out” link at the base of any Program SMS communication.

3.2. Regardless of whether you opt out of any direct marketing communications, you consent to continue to receive service based communications relating to your participation in the Program (including changes to these Terms and Conditions, Privacy Policy and Cookies Statements).

4. General Information

4.1. Each Rebel Active Card remains the property of Rebel. The Rebel Active Card is not transferable.

4.2. You are solely responsible for any government tax, duty or other charge imposed by law in any country in respect of the Program, your participation in the Program or any other transaction within the Program. Any liability arising out of or in connection with your participation in the Program is your responsibility.

4.3. Any failure or delay by Rebel in exercising its rights under these Terms does not constitute a waiver of those rights. Any waiver by Rebel must be in writing and signed by an authorised officer of Rebel.

4.4. Except as provided in any law which cannot lawfully be excluded or modified by agreement, Rebel does not accept liability whatsoever including for negligent acts and omissions with respect to the Program or any goods or services supplied under the Program. Any liability Rebel may have to You under statute in respect of such goods and/or services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying the goods and/or services again or repairing, or paying the cost of repairing, the goods, at the sole discretion of Rebel.

4.5. Subject to clause , any liability that Rebel may have to You whether for negligence or breach of contract or otherwise, is, to the extent permitted by law, limited in the case of any offer or a special discount, to reinstate that offer or special discount (as the case may be).

4.6. Where Rebel gives You notice by post, you agree that, unless otherwise stated in these Terms, the notice is deemed to have been provided to you on the date of actual receipt of the notice or on the date it would have been delivered in the ordinary course of post, on the date of email, whichever occurs first, provided it is sent to the last known address, email address, mobile number, Rebel has for you in connection with the Program.

5. Definitions

5.1. In these Terms, the following definitions shall have the following meaning:
- Benefits means the facilities, services, products, discounts, offers, competitions, activities and events or arrangements offered or available to Rebel Active Members from time to time which may be subject to further terms and conditions as notified to the Rebel Active Member from time to time.
- Program means the Rebel Active customer loyalty program, the arrangements by which a Rebel Active Member is given opportunities to receive the Benefits.
- Rebel means Rebel Sport Limited ACN 003 283 823 and includes any of its businesses including Live the Day ABN 78 003 283 823.
- Rebel Active Card means a Rebel Active Card issued by Rebel to each Rebel Active Member
- Rebel Customer Services Team means the customer services and complaints team of Rebel available on 1300 570 106.
- You or your is a reference to the Rebel Active Member whose name the Program account is held.
-Website means www.rebelsport.com.au and www.rebelsport.com.au/rebel-active as appropriate, or any other site operated on behalf of Rebel, as notified by Rebel from time to time.
