SEASON PASS TERMS & CONDITIONS

  1. Membership

    1.1 An applicant may apply to be a Member by completing and submitting an Application Form:
    a) in a Rebel Sport store;
    (b) online at the Rebel Sport Online Store; or
    (c) by post, addressed to:
    Rebel Season Pass

    1.2 Membership of the Program is only available to individuals. Membership is for personal use only and may not be used by or on behalf of any business or company.

    1.3 Each employee of Rebel Sport is not eligible to be a Member.

    1.4 Rebel Sport may refuse any application for membership at the sole discretion of Rebel Sport. If an applicant does not provide the necessary information on the Application Form, that applicant may not be eligible to participate in the Program.

    1.5 A Member is given the opportunity to receive offers, special discounts and enter into competitions. Competitions and other offers are subject to further terms and conditions, the details of which will be available at the time of each offer and may vary from time to time.

    1.6 Member discounts only apply to full-priced items sold by Rebel Sport and are not available in conjunction with any other offer, unless otherwise specified.

    1.7 Each Card remains the property of Rebel Sport. The Card is not transferable and is not a credit or charge card.

    1.8 Each Member must maintain a valid postal address and email address with Rebel Sport and notify Rebel Sport immediately of:
    (a) any change of email or postal address; and
    (b) a lost or stolen Card.

    For the avoidance of doubt, each prospective Member is required to have a valid email address in order to participate in the Program.

    1.9 If a Card is lost or stolen, a replacement may be obtained by visiting a Rebel Sport store. The issuing of a replacement Card is at the sole discretion of Rebel Sport.

  2. Participation
    2.1 Participation in the Program is subject to the full Terms and Conditions and any variations to them.

    2.2 Each Member consents and agrees to receive marketing information, offers and special discounts ("Rebel Sport Information") from Rebel Sport by email and SMS.

    2.3 A Member will not receive any further Rebel Sport Information from Rebel Sport if that Member:
    (a) selects the "OPT OUT" link at the base of any email received by that Member from Rebel Sport;
    (b) follows the links on the Website; or
    (c) calls the Customer Service Centre on 1300 570 106 and requests to receive no further Rebel Sport Information.

    2.4 Each Card may be used at each Rebel Sport store or online at www.rebelseasonpass.com.au.

    2.5 If a Member does not have that Member's Card with them at an Rebel Sport Store and wishes to receive an offer or a special discount available to Members, that Member may identify themself to an Rebel Sport member of staff. By providing details in order to be identified as a Member, each Member agrees to be bound by these Terms and Conditions.

    2.6 Any liability arising out of or in any way connected with a Member's participation in the Program is the responsibility of that Member.

    2.7 All conditions and warranties, whether express or implied and whether arising under statute or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the Program are expressly excluded to the full extent permitted by law. Any liability Rebel Sport may have to a Member under statute in respect of such goods and services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again or repairing, or paying the costs of repairing, the goods, at the sole discretion of Rebel Sport.

    2.8 Subject to paragraph 2.6, any liability that Rebel Sport may have to a Member whether for negligence, breach of contract or otherwise is, to the extent permitted by law, limited in the case of any offer or a special discount, to reinstate that offer or special discount (as the case may be).
  3. Changes and Termination

    3.1 Rebel Sport reserves the right to change, suspend or terminate these Terms and Conditions, the Program, any benefits and discounts available under the Program or any membership at any time. Rebel Sport will make all reasonable efforts to communicate advance written notice of such changes ("Advance Notice") using methods including, but not limited to notification on the Website and email to each Member. Rebel Sport will provide the Advance Notice in order that each Member may terminate participation in the Program during the period of Advance Notice.

    3.2 A Member may terminate participation in the Program online at the Website, or by calling our Customer Service Centre on 1300 570 106.

    3.3 A Member continuing to use a Card after the expiry of the period of Advance Notice will be deemed acceptance by that Member of the amended Terms and Conditions, the Program, any benefits and discounts available under the Program or any membership (as the case may be).

    3.4 Any amended Terms and Conditions, the Program or any benefits and discounts available under the Program will be available online at the Website.

    3.5 Rebel Sport may terminate a Member's participation in the Program without notice for any reason including, without limitation, if a Member:
    (a) fails to comply with these Terms and Conditions;
    (b) provides Rebel Sport with any misleading information;
    (c) registers and/or activates more than one account.
  4. General
    4.1 The Rebel Group Privacy Policy forms part of these Terms and Conditions, but shall prevail over these Terms and Conditions in the event of any inconsistency.

    4.2 In these Terms and Conditions, the following definitions shall have the following meaning:
    "Rebel Sport" means Rebel Sport Limited A.B.N. 78 003 283 823;
    "Application Form" means the application form to be completed and submitted by an individual to Rebel Sport in order to be a Member;
    "Card" means a Program card issued by Rebel Sport to each Member;
    "Members" means the members of the Program and "Member" means any one of them;
    "Program" means the Rebel Season Pass Customer Loyalty Program, the arrangements by which a Member is given opportunities to receive offers, special discounts and enter into competitions;
    "Rebel Group" means Rebel Sport Limited A.B.N. 78 003 283 823 trading as "Rebel Sport", A-Mart All Sports Pty Limited A.B.N. 80 009 955 462 and Rebel Sport Limited A.B.N. 78 003 283 823 trading as "Performance Sport by Rebel Sport" including any related bodies corporate, subsidiaries or affiliated companies of Rebel and Amart;
    "Website" means www.rebelseasonpass.com.au.
    (b) provides Rebel Sport with any misleading information;
    (c) registers and/or activates more than one account.
Privacy Statement
Please read our privacy policy, the Rebel Group Privacy Policy, available at the Website.
We respect your privacy. Rebel Sport Limited A.B.N. 78 003 283 823 ("Rebel Sport") does not sell or lease personally identifying information (such as your name, address, telephone number, bank and credit card account numbers) to non-affiliated companies or entities.
We do record information regarding the purchases made with your Season Pass card to help us provide you with special offers and other information. Rebel Sport also may use this information to provide you with personally tailored coupons, offers or other information that may be provided to Rebel Sport by other companies.

  1. TERMS AND CONDITIONS

    1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

    2. Entry is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Employees (and their immediate families) of the Promoter, participating Rebel and Amart retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

    3. Promotion commences at 9:00am AEST on 30/04/2013 and ends at 11:59pm AEST on 31/05/2013 (“Promotional Period”).

    4. To be eligible to enter and receive an entry card with a unique code, individuals must purchase one or more ‘Skins’ branded product(s) from any Rebel or Amart store in Australia during the Promotional Period. It is an entrant’s responsibility to request an entry card from the participating Rebel or Amart store in the event they do not initially receive one. One (1) entry card will be awarded for each Skins branded product purchased within a transaction.

    5. To enter, individuals must then during the Promotional Period, visit www.skinswinajeep.com.au, follow the prompts to the promotion entry page, input the requested details including the unique code (found on the entry card/s provided at the time of purchase) and submit the fully completed entry form.

    6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

    7. Incomplete or indecipherable entries will be deemed invalid.

    8. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Skins product purchased; (b) each entry must be submitted separately and in accordance with entry requirements; (c) only one (1) unique code per entry is permitted; (d) the same unique code cannot be used more than once; and (e) unrecognised codes will be deemed invalid.

    9. Entrants must retain their original Rebel or Amart purchase receipt(s) and entry cards clearly showing the unique code(s) used to enter for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.

    10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

    11. There will be one (1) minor prize awarded for each day of the Promotional Period (32 in total) and one (1) major prize awarded at the conclusion of the promotion. Entries received between 12.00am and 11.59pm AEST each day (excluding the first day where entries open at 9:00am AEST) will be entered into the prize draw for that day, which will take place on the following day. The minor prize draws will take place at 10:00am AEST each day from 01/05/2013 to 01/06/2013. Entries in each minor draw will NOT be entered into any subsequent minor draws but will be entered into the major prize draw. The major prize draw will take place on 05/06/2013 at 10:00am AEST. All minor prize draws and the major prize draw will take place at Autumn01, Level 5, 88 Pitt Street, Sydney NSW 2000. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified in writing within two (2) business days of the relevant draw, and the major prize winner’s name will be published online at www.skinswinajeep.com.au for a period of 28 days commencing on 11/06/2013 and published in The Australian newspaper on 11/06/2013. The Promoter’s decision is final and no correspondence will be entered into.

    12. MAJOR PRIZE: The first valid entry drawn in the major prize draw will win the major prize of a black Jeep Wrangler 2 door Sport (3.6L) with automatic transmission. In the event the colour black is not available the Promoter in its absolute discretion and subject to availability will determine the colour of the Jeep Wrangler awarded. The total value of the vehicle is up to AU$43,420.00, including one year’s registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). All other costs are borne by the winner.

    13. The colour of the major prize will be black. Should the colour black not be available due to stock or other unforeseen circumstances, the Promoter will procure Chrysler Australia Pty Ltd ABN 23125956505 trading as Fiat Chrysler Group (“Chrysler”) to provide the winner’s preferred colour but the colour cannot be guaranteed and is subject to availability.

    14. Additional insurance, options, petrol and all other ancillary costs (including travel to and from the nearest Jeep Dealership as nominated by Chrysler to collect the major prize vehicle) are the responsibility of the winner. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.

    15. The winner must collect the major prize from the nearest Jeep Dealership as nominated by Chrysler.

    16. If the winner of the major prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf and will be registered in the name of this nominated parent or guardian.

    17. If the winner is, through any legal incapacity or otherwise, unable to register the major prize in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the major prize is awarded. It is a condition of accepting the prize that the winner (or the winner’s parent/legal guardian if the winner is under the age of 18) may be required to sign a legal release in a form to be determined by the Promoter in its discretion.

    18. MINOR PRIZE: The first valid entry drawn in each minor prize draw will each win a $200 Skins voucher redeemable at www.skins.net and will be valid for 3 months from the date of the draw. Vouchers are redeemable in one (1) transaction only and no refund will be issued for any unused balance.

    19. Any ancillary costs associated with redeeming the Skins voucher are not included. Any unused balance of the Skins voucher will not be awarded as cash. Redemption of the Skins voucher is subject to any terms and conditions of the issuer including those specified on the Skins voucher.

    20. Subject to the unclaimed prize draw clause, if for any reason a winner does not take or redeem a prize by the time stipulated by the Promoter, then the prize will be forfeited.

    21. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

    22. Total prize pool value is up to $49,820.00. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

    23. A draw for any unclaimed prizes may take place on 05/09/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw. In the event the major prize is awarded in the unclaimed prize draw, the major prize winner’s name will be published online at www.skinswinajeep.com.au for a period of 28 days commencing on 10/09/2013 and published in The Australian newspaper on 10/09/2013.

    24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

    25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

    26. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

    27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents and participating Amart and Rebel stores) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion and/or in connection with the prizes.

    28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents and participating Amart and Rebel stores) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter and/or the participating Amart and Rebel Stores; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

    29. As a condition of accepting the major prize, the major prize winner (or their parent or guardian in the event they are under the age of 18) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

    30. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to Amart and Rebel stores, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter, Amart and Rebels stores and the prize suppliers, may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

  1. Terms and Conditions

    1. The Promoters are Rebel Sport Limited A.B.N. 78 003 283 823 (“rebel”) and A-mart All Sports Proprietary Limited (PTY) Sports A.B.N 80 009 955 462 (“Amart Sports”), both of 75A Carnarvon Street, Silverwater, NSW 2128, telephone 02 8866 6500 (each a “Promoter”)The supplier of the Prize is Adidas Australia Pty Limited (ABN 80 058 390 659) Level 1, 37 Dunlop Road, Mulgrave, Victoria 3170, telephone 03 9263 5275 (the “Prize Provider”).

    2. Information on how to enter and the Prize form part of these terms and conditions (“Terms and Conditions”). Entry into the Competition is deemed acceptance of these terms and conditions.

    3. The Competition commences at both rebel and Amart Sports stores on 22nd April 2013 and closes at 6:00pm (AEDT) on 26th May 2013 (“Promotional Period”). All entries must be received by the Promoter(s) within the Promotional Period.

    4. Entry is only open to Australian residents aged 18 years or over, that are members of either of the Promoter’s Loyalty Clubs being the rebel Season Pass or rebel Active or Team Amart (“Loyalty Club”). Membership to the Loyalty Club is subject to the Loyalty Club’s standard membership terms available at rebelsport.com.au (for rebel Season Pass and rebel Active) or amartsports.com.au (for Team Amart). Employees of the Promoter, Prize Provider, agencies associated with this Competition, and their related bodies corporate, and their immediate families are ineligible to enter.

    5. To enter, eligible individuals must, during the Promotional Period, either:
    (a) purchase (a “Qualifying Purchase”) the adidas official Men’s or Youth The British Lions jersey (Mens Z21746 and/or Youth Z21752) (“Eligible Product”) from either a participating rebel store and present their rebel Loyalty Club card OR a participating Amart Sports store and present their Amart Sports Loyalty Card at the time of making the qualifying purchase. If an individual fails to present their rebel or Amart Sports Loyalty Club card at the time of making the Qualifying Purchase, they will not receive an entry into the draw; OR
    (b) purchase (a “Qualifying Online Purchase”) an Eligible Product at either rebelsport.com.au or amartsports.com.au. Individuals must enter their rebel Loyalty Club card number (on the rebel site) or their Amart Sports Loyalty Club card number (on the Amart Sports site) where indicated at the time of making the online purchase, or become a member of either the rebel Sport or Amart Sports loyalty program during the Promotional Period. The Promoter will then identify individuals who made a Qualifying Online Purchase from the Loyalty Club bases to then include into the Competition. If an individual fails to enter their rebel or Amart Sports Loyalty Club card at the time of making the Qualifying Online Purchase, or fails to become a member of the rebel or Amart Sports Loyalty Club program after making the Qualifying Online Purchase but within the Promotional Period, they will not receive an entry into the draw.

    6. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per transaction/purchase receipt (regardless of the number of Eligible Product purchased in that transaction in excess of one (1)); and (b) each entry must be submitted separately and in accordance with entry requirements.

    The Prize, the Draw and Notifications

    7. The total Prize pool value is up to AU $11,000 (including GST) and the “Prize” includes:
    (a) Tickets for two (2) people (the winner and the winner’s guest) to attend the following British & Irish Lions Tour Games (the “Games”), to see the British & Irish Lions play (subject to injury, illness or other circumstance preventing British & Irish Lions players from participating in the selected games, in which case the Prize includes tickets to the game and the Promoter and Prize Provider are not required to provide the winner with any compensation or further Prize);

    7.a.1. First Test between Qantas Wallabies and British & Irish Lions on Saturday 22nd June 2013 at Suncorp Stadium, Brisbane.

    7.a.2. Second Test between Qantas Wallabies and British & Irish Lions on Saturday 29th June 2013 at Etihad Stadium, Melbourne.

    7.a.3. Third Test between Qantas Wallabies and British & Irish Lions on Saturday 6th July 2013 at ANZ Stadium, Sydney.
    (b) Subject to clause 18(b), two (2) return Economy class flight tickets from the winner's nearest Australian capital city to Brisbane, Melbourne and Sydney to coincide with the Games mentioned in 7(a);
    (c) Subject to clause 18(b), twin share accommodation for three (3) nights at a minimum 3-star hotel (to be selected by the Promoter) to coincide with the British & Irish Lions Games mentioned in 7(a). The three (3) nights twin share accommodation will be issued as three (3) separate one (1) night bookings with one (1) night in Brisbane, Melbourne and Sydney;
    (d) A British & Irish Lions jersey signed by selected (subject to availability) British & Irish Lions players for the winner only;
    (e) Subject to clause 18(b), two (2) return Economy class flight tickets from the winner's nearest Australian capital city to Brisbane and twin share accommodation for one (1) night at a minimum 3-star hotel (to be selected by the Promoter), and a chance for the winner and the winner’s guest to meet selected British & Irish Lions players (subject to injury, illness or other circumstance preventing British & Irish Lions players from participating in the appearance, in which case the Prize Provider are not required to provide the winner with any compensation or further Prize) on Saturday 8th June 2013 in Brisbane; specific location to be confirmed.

    8. The first valid entry drawn will be deemed the winner (“the Winner”) and the next three (3) sequential alternative valid entries (“Back-up Winners”) will be drawn at 10.00am (AEDT) on 27th May 2013 at the Promoters’ office , 75A Carnarvon St, Silverwater, NSW, 2128.

    9. Notifications: The Promoter will notify the Winner in writing within two (2) business days of the draw, and by phone and by any other means reasonably available to the Promoter each day until contact is made or 5:00 p.m. (AEDT) 1st June 2013. The Winner’s name will be published in The Australian on 29th May 2013.

    10. To be able to accept the Prize, the Winner and the Winner’s guest must be available to travel to Sydney, Melbourne and Brisbane. If the Winner fails to claim and collect the Prize by 5:00 p.m. (AEDT) 1st June 2013 or the Winner’s entry is deemed invalid by the Promoter, the Winner is deemed to have forfeited and abandoned the Prize. The Promoter will contact the first, second and third back-Up Winners sequentially, to confirm their eligibility to claim the Prize commencing at 10:00am (AEST) on 2nd June 2013 at the Promoter’s office. The Promoter will notify the Back-Up Winners by phone or in writing within two (2) business days. The alternate winner’s name, if any, will be published in The Australian on 4th June 2013. If still uncollected by any of the Back-Up Winners by 6th June 2013, the unclaimed Prize will be deemed forfeited and abandoned and the Prize will be donated to charity.

    11. If any Prize is unavailable or otherwise unable to be supplied or the Competition is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter may substitute the Prize with a Prize of equal value and modify, suspend, terminate or cancel the Competition, subject to any directions from a regulatory authority.

    General Conditions

    12. The Prize, or any unused portion of the Prize, cannot be transferred, exchanged, or redeemed for cash.

    13. The Promoter is entitled to verify the validity of entries and the indentity entrants/winner(s), and to disqualify any entrant/winner who submits an entry that is contrary to these Terms and Conditions, or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage is not a waiver of those rights.

    14. Incomplete, indecipherable or illegible entries will be deemed invalid.

    15. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

    16. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Prize Provider (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition and/or: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s or Prize Provider’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or Prize Provider (as the case may be); (d) any variation in Prize value to that stated in these Terms and Conditions; (e) if the selected British & Irish Lions Tour Games are cancelled or rescheduled for any reason beyond the reasonable control of the Promoter or Prize Provider (as the case may be); (f) any tax liability incurred by a winner or entrant; or (g) taking and redemption of the Prize.

    17. As a condition of accepting the Prize, the winner and his/her companion must sign any legal documentation as and in the form required by the Promoter, the Prize Provider and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

    18. Conditions relating to the Prize and travel arrangements: (a) Important Condition: The winner and their guest must be available to travel at the periods nominated which are subject to booking and flight availability; must take the travel in conjunction with the dates to attend the British & Irish Lions Tour Games at the venues and on the dates prescribed in clause 7, and must be able to satisfy the conditions for travel to and from Sydney, Brisbane and Melbourne.
    (b) If the British & Irish Lions Tour Games in clause 7(a) as well as the British & Irish Lions in-store appearance described in clause 7(d) are taking place in the same State as the Winner, the Promoter and Prize Provider will not be required to provide accommodation and travel for the Winner (and the Winner’s guest) for the game and/or in-store appearance taking place within the same State as the Winner.
    (c) The Winner and the Winner’s guest are responsible for all other expenses including spending money, meals , drinks, transfers to the hotel and other activities , laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the Prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. Frequent flyer points will not form part of the Prize. The Winner may be required to present their credit card at time of accommodation check in.
    (d) The Winner and the Winner’s guest must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Melbourne, Brisbane, Adelaide, Perth, Sydney, Hobart, Darwin and Canberra).
    (e) It is the Winner’s personal responsibility to ensure that they have valid documentation for the flights. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of the relevant authorities will be the sole responsibility of the Winner and the Winner’s guest.

    19. Prize is subject to the standard terms and conditions of individual service providers providing each element of the Prize.

    20. The British & Irish Lions Tour Game ticket Prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter, Prize Provider and event organisers hereby expressly reserve the right to eject the Winner and the Winner’s guest for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Prize.

    21. The Promoter and Prize Provider collect personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to opt out, access, update or correct information to the Promoter or Prize Provider. All entries become the property of the Promoter and Prize Provider. By submitting an entry and accepting the Prize, the winner expressly consents to the Promoter using the Winner’s entry (either in part or in full), name, likeness, image and/or voice to be reproduced and/or published in any medium for an unlimited period without renumeration for the purpose of promoting this Competition, the Promoter’s business, and any products manufactured, distributed and/or supplied by the Promoter.

  1. Terms and Conditions

    1. The Promoter is Rebel Sport Limited A.C.N. 78 003 283 823 of 75A Carnarvon Street, Silverwater, NSW 2128 (the “Headquarters”).

    2. Entry into the Competition is deemed acceptance of these terms and conditions.

    3. Employees of the Promoter and their immediate families are ineligible to enter.

    4. The Competition commences at 8.30 am (AEST) on 10 May 2013 and closes on at 6:00 pm AEST on 31 July 2013 (“Promotional Period”). All entries must be received by the Promoter within the Promotional Period.

    5. Entry is only open to Australian residents aged 18 years or over, that are members of the Promoters Loyalty Club ”Rebel Season Pass” and that register their membership and purchase $50.00 or more on any Rojo or Elude products in one transaction from the Promoter during the Promotional Period. Employees of the Promoter and their immediate families are ineligible to enter. Multiple entries are permitted subject to each purchase being processed separately and otherwise in accordance with the above.

    The Prize, Prize Draw and Notifications

    6. The Prize(s) is a Japan Winter Season 2013/14 ski holiday package for two people to Niseko, Hirafu prefecture in Japan with a total prize value estimated at AU$10,000 (GST inclusive) as at 18 April 2013, and includes:
    • Two return Economy airfares from the nearest Australian Eastern capital City. Airline to be confirmed by Skijapan.com depending on travel dates. All airline and airport taxes from Australian Eastern Cities to Japan are included. Airfares include return transfers to Chitose Airport (Sapporo) in Japan.
    • 7 nights in a 4 star 1 bedroom twin share premium apartment located in the heart of Niseko, Hirafu Japan.
    • 2 x 6 days All Mountain Niseko United lift passes.
    • 2 x return Chitose-Hirafu bus transfers.

    7. The winning entry will be drawn at 10.00 am (AEDT) on Monday, 5 August 2013 at the Promoter’s Headquarters.

    8. The Promoter will notify the winner(s) in writing and by phone. The winner’s name will be published in The Australian on Friday, 9 August 2013.

    9. If the winner fails to claim and collect the prize by Sunday 15 September 2013 or the winner’s entry is deemed invalid by the Promoter, the winner is deemed to have forfeited and abandoned the prize. The Promoter will draw another winner at 10 am (AEDT) on Monday 16 September 2013 at the Promoter’s Headquarters. The Promoter will notify the alternate winner by phone and in writing within 2 days. The alternate winner’s name will be published in The Australian on Wednesday 18 September 2013. If still uncollected by Sunday 13 October 2013, any remaining prizes will be deemed forfeited and abandoned.

    10. If any prize is unavailable or otherwise unable to be supplied, the Promoter may substitute the prize with a prize of equal value, subject to any directions from a regulatory authority.

    General Conditions

    11. Prize(s) cannot be transferred, exhanged, or redeemed for cash.

    12. The Promoter is entitled to verify the validity of entries and the indentity entrants/winner(s), and to disqualify any entrant/winner who submits an entry that is contrary to these Terms and Conditions, or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage is not a waiver of those rights.

    13. Incomplete, indecipherable or illegible entries will be deemed invalid.

    14.     15.1. Accommodation includes a twin share apartment and travel is subject to availability through skijapan.com. This prize must be used in the winter season 2012/13.
    15.2. Availability and booking constraints. The prize cannot be taken between the following dates: from 21 December 2013 to 3 January 2014 and from 31 January 2014 to 8 February 2014. Accommodation and airfares for the Winning Entry must be booked prior to 16 September 2013; while if a redraw is required, the bookings for the alternate winner must be made prior to 13 October 2013.
    15.3. The winner and their companion are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), change of flight charges, excess baggage allowances, any trip cancellation or amendment fees and any in resort upgrades of equipment, accommodation and services, laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.
